common property - strata title


All that part of the unit plan which is not units or lots in a Strata or Unit Plan. For example, common areas such as lawns and gardens, curtilage, foyer, swimming pool, driveways, fences, load bearing walls, structural cubic space, service pipes, outside windows, and outside doors.

The body corporate holds the common property as agent for the lot owners as tenants in common in shares equal to the unit entitlements. Therefore, each lot owner has the right to use and enjoy the common property, a right that can only be restricted by the articles of corporation and legislation.
