TENANCY
IN COMMON
The
coowners have divided interests in the property. Two or more persons
are entitled to a distinct share in a piece of real estate. Before
the introduction of strata(unit) title, block of flats were purchased
by the owners as tenants in common. Each tenant was entitled
to the whole of the premises but occupation of parts were solved by
an agreement which created a right for exclusive occupation of that
part. However, the agreement could not be registered so that it could
not be enforced against subsequent purchasers.
EXAMPLE
The
ownership of the common property in a strata scheme are the lot
owners as tenants in common. The ratio is in accordance with unit
entitlement.
