VOLUNTARY
ACQUISITION
There
are two distinct types of voluntary
acquisition:
- an
acquisition by a government agency that has no power to resume land
should negotiations fail.
- when a
"voluntary" acquisition is negotiated in the face of a threat (that may
be only implied) some doubts exist about the voluntary nature of the
acquisition.
Problems arise with
the second approach as to whether or not it becomes part of the
resumption process, if the owner refuses and the land is resumed at a
later date.
