UNDUE
INFLUENCE
If
one party induces the consent of the other by undue influence the
contract is voidable in equity. Undue influence is
illegal pressure falling short of duress Williams v Bayley.
EXAMPLE
In
special relationships such as parent and child, solicitor and client,
but not agent and principal. In such cases undue influence is
presumed and must be rebutted by the defendant.
