TENANCY
AT WILL
An
agreement where the tenant has a right to exclusive occupation for an
indefinite period but the tenancy can be terminated at the will of
either party. Such a tenancy can arise by implication. For example,
upon the exchange of contracts the purchaser enters into occupation
of the bought property or agistment rights under a rural agreement.
The tenant cannot assign or sublease a tenancy at will and is ended by the
death of either party.
