AT SUFFERANCE
Tenancy
at sufferance is a tenancy that arises from implication. For
example, where the tenant remains in occupation after the termination
of a lease and the landlord takes no measures to either evict the
tenant or find a new tenant. The landlord can only claim for a
reasonable sum as rent owing after the tenancy has been terminated.
If the landlord accepts rent during the holding over period
the tenancy becomes a periodic lease.
