A
lease can be surrendered by one of the following methods:
- express surrender
- a reconveyance of the lessee's interest to the
lessor by way of a memorandum of surrender of lease for a registered
lease under the LTA.
- surrender by law : both parties to the
lease act in a way inconsistent with the terms and covenants of the
lease agreement. That is, their actions confirm that both parties agree
to surrender. For example, when a tenant moves out and a new tenant
moves into the premises so that the lessee has allowed the new
occupation.
