SUBAGENCY
(CONJUNCTION AGENCY)
An agent's authority is a
contract for a personal service. Therefore the agent cannot appoint
somebody else to carry out the agent's duties. However, the agent can
have a servant carry out procedural or mechanical acts such as
measuring the building. Where a subagency agreement is
permitted by the principal the subagency agreement must be in
writing. The subagency agreement should contain the prescribed terms
applicable to the agency agreement and the subject, duration, and
remuneration under the agreement.
