A
simple contract is one which requires consideration to become an
enforceable contract. Simple contracts for land, and an agency
agreement must be in writing or evidenced in writing. The evidence of
contract can be contained in a number of documents, and oral
representations. Part
performance may be used as evidence of a contract lacking a
written memorandum where it is required to be in writing.
