RIGHT TO OCCUPY AFTER A COMPULSORY TAKING
If the claimant is allowed to remain in occupation
after the resumption of the land then the goodwill paid if any, should
be deferred for that period. If the owner is allowed to stay on the
land with limited tenure (in Bennett's case 7-10 years) until required
by the authority this will substantially reduce the amount of
compensation payable under loss of goodwill and disturbance compared
with not being able to obtain suitable premises at all - Bennett's case.
