REGISTRATION OF INTERESTS IN LAND

Interests in torrens land can be registered on the certificate of title. Only registered dealings are recognised as statutory interests under the LTA and therefore, the holder of such an interest is the registered proprietor of the lease, mortgage etc. Evidence of title is by the particular dealing such as a registered mortgage. Registration must be in the approved form but unregistered dealings are not illegal and are often enforceable. Some interests cannot be registered under the LTA such as the declaration of a trust.
