PRIVITY
OF CONTRACT
At
common law the general rule is that no one is entitled under or bound
by a contract to which that person is not a party. Further, an
existing contract between 2 parties cannot be disturbed, or
interfered with by a 3rd party. Privity of contract does not affect a
cause of action arising in tort such as from a breach of a duty of
care.
