NOTICE
TO QUIT
A
notice to quit will terminate a periodic tenancy such as the
holding over period of the lease. It cannot be used for
a lease of a fixed term. The document advises the tenant that the
tenancy will cease at the specified date and must be clear and
unambiguous as to the date of termination, description of the
premises, and be correctly addressed.
An
agent should not accept money after serving a notice to quit
otherwise an implied tenancy
could be created. If money is accepted, the receipt should state
"without prejudice to notice to quit".
