NOTICE TO COMPLETE


Where no time is given for the completion of a contract, at common law, it should be completed within a reasonable time. If the contract has not been completed after a reasonable time the innocent party can serve a notice to complete on the defaulting party. It is a formal notice that calls upon the other party to complete by a given date. If the defaulting party again fails to complete the innocent party can either rescind the contract or seek a court order for specific performance.
