MORTGAGE DISCHARGE


The discharge of a mortgage agreement can be summarised as follows:

• TORRENS
  A mortgage over Torrens land is discharged by registration of the memorandum of discharge and upon registration of that memorandum, the interest of the mortgagee ceases.
• EQUITABLE
  Requires the receipt or some other satisfactory evidence of payment sufficient to discharge the mortgage.
