LIABILITY
FOR FIRE
There is no
general rule that the occupier of land is liable whenever a fire
kindled on the land escapes to the land of another. Liability for
damage caused by fire will depend upon the following:
- whether or not the occupier is liable for
negligence
- where the fire starts or spreads as a result
of non
natural user of the occupier's land the occupier is liable according to
the rule in Ryland v Fletcher.
