INTERPLEAD
If a dispute
should arise between the vendor or potential purchaser as to the
ownership of deposit money paid into the agent's trust account the
agent should interplead. This requires the agent to pay the money
into the court which will hear the dispute and dispose of the money
according to the court's decision. The other party is served with a
claim and the agent as interpleader takes no part in any further
action. The agent must remain indifferent as he/she is the
stakeholder
.
