INNOCENT
MISREPRESENTATION
Representations
made which are untrue but made without knowledge of their untruth,
and without any intention to deceive. For example, an agent
mistakenly believes the cottage to be outside the flight path and the
buyer buys on that basis.
Compare
with fraudulent
misrepresentation.
The
available remedies to the innocent party depend upon whether or not
the remedy is classified as a condition
or warranty.
