GOODS
– STANDARD CONTRACT
Under
a typical standard contract chattels are referred to as “goods”.
GOODS
INCLUDED IN SALE
Subject
to any rights conferred by the Trade Practices Act 1974, and except
as specified in the Contract, the Seller gives no warranties as to
the present state of repair of any of the Goods. However, the Seller
must give the Goods to the Buyer on completion in the same state of
repair they are in at the date of the Contract, fair wear and tear
excepted.
The
Goods set out in the Schedule are included in the Price and become
the property of the buyer on completion. The Seller warrants that the
Goods are unencumbered and that the Seller has the right to sell
them.
