Negligence is the failure to behave reasonably in circumstances where the law lays down a duty of care. If a party suffers as a result of a breach of the duty of care then that party can claim damages against the person or company that caused the breach. Under a contract of agency an agent is required to perform his/her duties with the care and skill that would be reasonably required of such an agent.
