The following persons do not have capacity to enter into contracts:
minors under certain conditions
bankrupts
mentally disordered persons under certain circumstances
drunkards
convicts.
A party to a contract without capacity cannot overcome the defect by acting through an agent with capacity. For example, a real estate agent cannot buy a house on behalf of a bankrupt.
